من أهم الأدلة في القضايا الجنائية التقارير الطبية الشرعية و هو قد يكون دليل إدانة و قد يكون دليل براءة و لكن لا يصلح لوحده كدليل افتتاحية الموضوع

 من واقع خبرتي بصفة محامي أن التقرير الطبية الشرعية لها شأنها في جرائم الاعتداء على جسم الإنسان كالقتل و الضرب و الاغتصاب و غيرها من الجرائم، و لما كان الأمر كذلك فكان من المتعين على كل محامي  أن يكون عنده ألمام بهذا التقرير و فنياتها لان فهمها سبيل للدفاع عن موكله أمام جهات التحقيق و أمام جهات القضاء و كثيرًا من  أحكام البراءة كان فهم التقارير الطبية الشرعية هي السبيل الوحيد،  للبراءة و التقرير الطبية الشرعية هي نوعين الأول منها التقرير الطبي الشرعي الأولي و الثاني منها التقرير الطبي الشرعي النهائي الفارق بينهما أن التقرير الطبي الشرعي الأولي أول رأي فني يوضع من قبل طبيب الاستقبال في المستشفيات الحكومية عن الإصابات و كثيرًا يعتمد عليه في جرائم الاعتداء على جسم الإنسان الذي تزول معالم الاعتداء عليها في وقت قصير و هو المدار عليه أمام جهات التحقيق و المحاكم عن جرائم الضرب البسيط، النوع الثاني هو التقرير الطبي الشرعي النهائي و هو التقرير الذي يعده احد الخبراء في مصلحة الطبي الشرعي بناء على تكليف النيابة العامة أو المحكمة و يعد هذا التقرير لبيان الصفة التشريحية للمتوفي أو بيان الإصابة في حالة العدوان على الجسد الذي لم تبلغ حد الوفاة    

الدفع بعدم صحة إسناد التهمة من أهم الدفوع في القضاء الجنائي في قضاء محكمة النقض

الدفع بعدم صحة إسناد التهمة إلى المتهم هو دفع قانوني يُستخدم من قِبَل المتهم أو محاميه للطعن في الأساس القانوني أو الأدلة التي تربط المتهم بالجريمة. الهدف من هذا الدفع هو التأكيد على أن الأدلة المقدمة لا تثبت بما يكفي أن المتهم هو الشخص الذي ارتكب الجريمة، أو أن الإجراءات المتبعة في توجيه التهمة كانت غير قانونية.

نبذة عن أحكام محكمة النقض دعمت هذا النوع من الدفع في العديد من الحالات، حيث أكدت أن الإدانة يجب أن تستند إلى دليل يقيني وقاطع، وليس إلى مجرد شكوك أو استنتاجات. في هذه الحالات، يُعتبر تقديم أدلة غير كافية أو غير موثوقة دافعًا قويًا لقبول الدفع بعدم صحة إسناد التهمة.

بعض النِّقَاط الرئيسية التي أيدتها أحكام محكمة النقض:

  1. التناقض في الأدلة: إذا كانت الأدلة المقدمة متناقضة أو غير متماسكة بشكل يؤثر على قوة الاتهام، فإن ذلك يتيح قَبُول الدفع بعدم صحة إسناد التهمة. المحكمة قد تقضي ببراءة المتهم إذا كانت الأدلة غير كافية أو مضللة​

  2. الإجراءات الباطلة: إذا تم توجيه التهمة بناءً على إجراءات غير قانونية أو مخالفة للقانون، مثل الحصول على أدلة بطرق غير قانونية، يمكن للمتهم الدفع ببطلان هذه الإجراءات وعدم صحة إسناد التهمة إليه.

  3. غياب النية الجنائية: في بعض الجرائم، يجب إثبات وجود نية جنائية لاعتبار التهمة صحيحة. إذا لم يتمكن الادعاء من إثبات وجود هذه النية، يمكن للمتهم الدفع بعدم صحة إسناد التهمة.

خلاصة:

الدفع بعدم صحة إسناد التهمة هو وسيلة قانونية قوية إذا كانت الأدلة المقدمة غير كافية أو غير قانونية. محكمة النقض عادة ما تؤيد هذا الدفع في حالات وجود تناقض في الأدلة أو بطلان في الإجراءات.

حكم هام و رائع لمحكمة النقض في تقديرها قيمة التعويض عن الضرر الناتج عن المسئولية التقصيرية

 مفاد هذا الحكم :-

أن التعويض يقدر بقدر الضرر،و لئن كان هذا التقدير من المسائل الواقعية التى يستقل بها قاضي الموضوع ، فأن تعيين العناصر المكونة قانوناً للضرر و التى يجب  ان تدخل في حساب التعويض من المسائل القانونية التى تهيمن عليها محكمة النقض ،لان هذا التعيين من قبيل  ،التكييف القانوني للواقع ،و كلما كان الضرر متغيراً تعين على القاضي النظر فيه لا كما كان عندما وقع بل كما صار  إليه عند الحكم مراعياً التغير في الضرر ذاته ،من زيادة راجع أصلها الى خطأ المسئول أو نقص كائناً ما كان سببه ، و مراعياً كذلك التغير في قيمة الضرر .  بارتفاع ثمن النقد أو انخفاضه ،و بزيادة أسعار المواد اللازمة لإصلاح الضرر أو نقصها ذلك أن الزيادة في ذات الضرر التى يرجع اصلها الى الخطأ و النقص فيه أياً كان سببه غير منقطعي الصلة به . أما التغير في قيمة الضرر فليس تغير في الضرر ذاته ، و إذا كان المسئول ملزماً بجبر الضرر كاملاً فإن التعويض لا يكون كافياً لجبره أذا لم يرع في تقديره قيمة الضرر عند الحكم ،و من ثم  كان لا وجه للقول بأن بأن تغير القيمة لا يمت الى الخطأ بصلة ،كما لا وجه للقول بأن المضرور ملزم بالعمل على إصلاح الضرر، فإدا هو تهاون فعليه تبعة تهاونه ،فإن الالتزام بجبر الضرر واقعا على المسئول وحده و لا على المضرور أن ينتظر حتى يوفي المسئول التزامه

من أهم أحكام النقض الصادرة في جناية التهديد عن طريق الوسائل الالكترونية سواء عن طريق المواقع الاجتماعية او الواتس اب او اياً كانت الميديا المستخدمة

أكدت محكمة النقض في حكم حديث لها أن إثبات إرسال عبارات التهديد كتابة عن طريق الوسائط الإلكترونية الحديثة بقصد إيقاع الخوف في نفس المجني عليه لحمله على أداء ما هو مطلوب يتوافر به أركان جريمة جناية التهديد المنصوص عليها بالفقرة الأولى من المادة 327 عقوبات. 

وبحسب "المحكمة" في حيثيات الحكم المقيد برقم 22620 لسنة 88 قضائية – أنه لما كانت جناية التهديد المنصوص عليها في الفقرة الأولى من المادة 327 من قانون العقوبات تتوافر إذا وقع التهديد كتابة بارتكاب جريمة ضد النفس أو المال، وكان التهديد مصحوبًا بطلب أو تكليف بأمر، وكان الحكم قد أورد بأسبابه قيام الطاعن بتهديد المجني عليهما عبر مواقع التواصل الاجتماعي، وتمكن من خداعهما وتحصل منهما على صور ومقاطع مرئية في أوضاع مخلة بالحياء وهددهما بنشرها.

و أكدت المحكمة في تفسيرها للكتابة بأنها ( وإذ كان مصطلح الكتابة قد ورد في المادة 327 سالفة الذكر على سبيل البيان في صيغة عامة لتشمل كافة وسائل الكتابة المختلفة سواء كانت بالطرق التقليدية أو بإحدى الوسائل الإلكترونية الحديثة، فإذا أثبت الحكم على الطاعن إرساله عبارات التهديد عن طريق الوسائط الإلكترونية الحديثة – وهي لوحة المفاتيح – بقصد إيقاع الخوف في نفس المجني عليهما لحملهما على أداء ما هو مطلوب، فإنه يكون قد استظهر أركان جريمة التهديد كما هي معرفة به في القانون، ويضحى منعى الطاعن في هذا الشأن على غير أساس.)
